What's New in Retrospective Rating

Update on rulemaking petitions.

April 9, 2014.

The department received two petitions from the Retro Advisory Committee (RAC), requesting changes to the rules pertaining to individual enrollment, and common ownership. In an effort to collect as much feedback as possible on these proposals, L&I hosted two public meetings, conducted personal interviews, and provided stakeholders the opportunity to submit written comments.

After reviewing all feedback received, the department has decided to convene a work group for each subject: individual enrollment, under Jessica Nau; and common ownership, facilitated by Julie Osterberg. These two work groups will include representatives from the Retro community, as well as department staff.

The next quarterly meeting for the Retro Advisory Committee will begin at 9:30 a.m,. Tuesday, April 15, at the L&I headquarters building in Tumwater.

Rulemaking Update.

February 26, 2014.

The department has decided to move ahead with proposed rulemaking to modify the retro adjustment calculations and the factors used within the calculations to ensure the equity of the distribution of retro refunds based on individual plan choices.

Informal Public Meeting.

January 24, 2014.

The department will hold two informal public meetings to accept feedback and exchange ideas regarding proposed Retro rules changes. We urge you to attend in person or by toll-free conference call. You can download the agenda (146 KB PDF) for both meetings (includes conference call instructions). The meetings are scheduled from 10:00 a.m.12:00 p.m.; on Monday, January 27 at the L&I office in Tukwila, and Friday, January 31, at L&I headquarters in Tumwater.


Petition for rulemaking

January 10, 2014.

The Department of Labor and Industries is considering changes to the current Retrospective Rating rules.

Two Petitions for Rulemaking were received from members of the Retro Advisory Committee. One petition requested revision to the current rules for Individual Retro participants. The other addresses Retro enrollment requirements for businesses under common majority ownership.

In addition to the two petitions, based on review of the first adjustment of the 2011 coverage year, the department identified a need to modify the retro adjustment calculations and the factors used within the calculations to ensure the equity of the distribution of retro refunds based on individual plan choices.
