Public hearing on Retro rule change

April 23, 2014

L&I filed a proposed rule change to remove the performance adjustment factor (PAF) from the calculation of the net insurance charge for participants that elect premium-based plans. The change would become effective prior to the July 1, 2014, enrollment cycle.

A formal Public Hearing to accept comments on this rule change has been scheduled to begin at 10 a.m. Tuesday, May 6, 2014, in room S117 of the L&I headquarters in Tumwater. A summary of the proposed rule change can be found on our website. You can also download the FAQ and consolidated feedback (348 KB PDF), previously received via written comments, personal interviews, and public stakeholder meetings.

Update on rulemaking petitions

April 9, 2014

The department received two petitions from the Retro Advisory Committee (RAC), requesting changes to the rules pertaining to individual enrollment, and common ownership. In an effort to collect as much feedback as possible on these proposals, L&I hosted two public meetings, conducted personal interviews, and provided stakeholders the opportunity to submit written comments.

After reviewing all feedback received, the department has decided to convene a work group for each subject: individual enrollment, under Jessica Nau; and common ownership, facilitated by Julie Osterberg. These two work groups will include representatives from the Retro community, as well as department staff.

You can download and print a summary of the feedback and frequently asked questions (327 KB PDF).

If you are interested in participating in either work group, please email Retro@Lni.wa.gov and state in the subject line which work group you would like to participate.

Petition for rulemaking

January 10, 2014

The Department of Labor and Industries is considering changes to the current Retrospective Rating rules.

Two Petitions for Rulemaking were received from members of the Retro Advisory Committee. One petition requested revision to the current rules for Individual Retro participants. The other addresses Retro enrollment requirements for businesses under common majority ownership.

In addition to the two petitions, based on review of the first adjustment of the 2011 coverage year, the department identified a need to modify the retro adjustment calculations and the factors used within the calculations to ensure the equity of the distribution of retro refunds based on individual plan choices.

For more information about these proposals, you can download the summary statements and cover letter (182 KB PDF), which also includes details of upcoming public meetings on January 27 (in Tukwila) and January 31 (in Tumwater).

Please contact retro staff with any comments, questions, or concerns.
