Providers may protest L&I claim decisions. Protests are also known as "requests for reconsideration."
File on time
- Submit your protest to L&I as soon as possible. You have:
- 60 days to protest a claim decision or a payment decision.
- 20 days to protest an adjustment that reduces the amount paid or a demand for repayment.
Select how you want to protest
If the request is not received within this time, the decision becomes final.
How to protest
- Submit your protest online or write a letter to the claim manager stating that you are protesting a decision. Your request should include:
- Claim number and your patient's name on every page.
- Date and description of the decision.
- Reason for your protest.
- Supporting medical information.
- If you are protesting an L&I decision to close a claim, be sure to include:
- Chart notes.
- An outline of the worker's current condition.
- Treatment program and prognosis.
- A statement explaining why you feel the claim needs to remain open from a medical standpoint.
L&I staff will
Review your protest and make a decision. You will be notified of the new decision by mail.
If you still disagree with the decision
You may appeal to the Board of Industrial Insurance Appeals (BIIA). See the Appeal to the Board page for more information.
