The purpose of this rulemaking is to make clarification and technical changes to the Board of Boiler Rules – Substantive (chapter 296-104 WAC) based on actions and requests of the Board of Boiler Rules.

The purpose of this rulemaking is to make clarification and technical changes to the Board of Boiler Rules – Substantive (chapter 296-104 WAC) based on actions and requests of the Board of Boiler Rules. The changes will: Allow the department to set times, date and location of board meetings with board approval, as the department has access to meeting room calendars, keep the requirements for rules interpretation but moves the procedure to the boiler website, establish rules for applying for Washington State Specials and extension of inspection frequency, Amend the rule to conform with the adopted API-510 and the NBIC, eliminate confusion of the term “agent”, remove conflict between rules and adopted code, remove installation standards from construction codes, and remove International Building Code (IBC) requirement from the boiler rules. A Public Hearing will be heldat 10:00 am on May 6, 2009 at the Tacoma L&I Office. The changes were adopted 5/27/2009 and became effective on 6/30/2009.

The purpose of this rulemaking is to make clarification and technical changes to the Board of Boiler Rules – Substantive (chapter 296-104 WAC) based on actions and requests of the Board of Boiler Rules. The changes will: clarify insurance inspector’s responsibilities; adopt current editions of inspection codes; adopt nationally recognized fuel train standards; clarify administrative codes for standards for installation; clarify administrative codes for standards for repair; and Update references throughout the rule. The changes were adopted 12/1/2008 and became effective on 1/1/2009.

The purpose of this rulemaking is to make clarification and technical changes to the Board of Boiler Rules – Substantive (chapter 296-104 WAC) and fee increases based on actions and requests of the Board of Boiler Rules. The changes removed the Board’s responsibilities for National Board (NB) exams and allowing the Boiler Chief to accept applications for Board approved criteria. Some additional changes are, extending the periods between boiler internal inspections to companies with Owner/User Inspection Programs and additional safety requirements were added to the preparation necessary prior to internal inspection. Finally a 5.53% fee increase, as approved by the Legislature to help cover the cost of the ongoing services for the Boiler program. The changes were adopted 5/27/2008 and became effective on 6/30/2008.

The Board of Boiler Rules recently made changes to WAC 296-104-540 regarding nuclear repairs and was not aware at the time that these revisions would impact a business in Washington. The National Board’s Pressure Relief Department stated that as long as the pressure relief valves are repaired under a documented quality program which is periodically audited by a third party, an equivalent level of safety will be maintained. Therefore the board drafted language to allow companies to continue to repair nuclear safety relief valves.

The purpose of this rulemaking is to make clarification and technical changes to the Board of Boiler Rules – Substantive (chapter 296-104 WAC) based on actions and requests of the Board of Boiler Rules. The changes include adding electronic submission of inquiries to the board for how rules are interpreted and revised, and increasing the boiler fees by 3.38%.
