The department received a petition to repeal the scope of work definitions for utilities construction and laborers in utilities construction. The petition states the repeal of these scopes of work would eliminate confusion for wage survey respondents, would allow the department to calculate a more accurate wage rate, and would be consistent with references from the federal Davis Bacon Act. The department will work with interested parties in deciding whether to repeal the scope of work definitions for utilities construction and laborers in utilities construction.608.

Prevailing wage rates on public works projects are determined and enforced according to the trade or occupation or “classification” of work actually performed. Rule language to write scope of work descriptions for dredge workers, truck drivers, and ready mix truck drivers was proposed on November 2, 2010. However, pursuant to Executive Order 10-06, the department is assessing which rules will move forward. For the time being, the proposed language has been withdrawn. The public hearing scheduled for December 9, 2010, has been cancelled.604.

The purpose of this rulemaking is to propose amendments to the prevailing wage rules to reflect court decisions and statutory amendments, integrate administrative policies, streamline current processes, create consistency with the Prevailing Wage Act, clarify language, add explanatory notes, and make housekeeping changes. The department is revising the prevailing wage rules because they have not gone through a comprehensive review since the early 1990s.553.
