Job Summary:

This position conducts investigations to determine compliance with the State of Washington Wage and Hour Laws, i.e. the Wage Payment Act, Minimum Wage Act, including unpaid overtime, final wages, and unauthorized deductions, violations of Child Labor Laws, Public Works Act, Employment Standards Regulations, Farm Labor Contractor and Agricultural Employment Laws. This involves obtaining evidence through document requests and auditing payroll records. Position will be required by the Wage Payment Act to prepare a Notice of Assessment (NOA) or a Determination of Compliance (DOC) on unresolved cases and testify in administrative hearings when necessary.

 

Industrial Relations Agent 2 (Spanish bilingual) will:
  • Serve, among others, Spanish-speaking individuals in resolving wage payment and employment standards complaints.
  • Interview workers to determine if they are being properly paid according to the State Wage and Hour laws and verify with review of employer’s documents and records.
  • Negotiate settlement of wages as a result of investigation of wage disputes between employers and employees,
  • Audit payroll records to determine violations of labor laws, including failure to agreed wages, overtime, unauthorized deductions, and violations of the
  • Prevailing Wage Act.
  • Maintain a working knowledge of other related acts established by state, federal and local governments in order to refer the public to appropriate agencies in cases where our laws did not apply.
  • Attend conferences, workshops, training sessions and staff meetings.
  • Prepare monthly reports (wage claims, amount collected, presentations and inspections made).
  • Assist in training other Industrial Relations Agents.
  • Testify in Administrative Hearings as a result of a DOC/NOA.

 

Preferred Qualifications:

Bachelor's degree

AND

Two years of experience in labor/employment relations and regulations, collection of revenue/taxes from employers/businesses, investigation of complaints of misconduct, audit of employer financial records or related experience.

Additional qualifying experience will substitute for education at the rate of one year of experience for two years of education.

 

Skills and Abilities:
  • Must speak, read and write proficiently in Spanish and English.
  • Investigate employer records, operations and worksites.
  • Interpret and enforce governmental laws, rules and regulations, and initiate enforcement actions.
  • Identify and analyze issues in dispute, recommend solutions and negotiate settlement.
  • Organize facts, arguments and conclusions in clear and logical sequence.
  • Apply rules of evidence, auditing, accounting and bookkeeping procedures.
  • Prepare written documents and monthly reports.
  • Overnight travel may be required.

  • Employees driving on state business must have a valid driver’s license.
  • Employees driving a privately owned vehicle on state business must have liability insurance on the privately-owned vehicle.
