Background

On September 13, 1994, the Federal Occupational and Health Administration (OSHA), issued a revision to an instruction on compliance guidelines and enforcement procedures of the Process Safety Management of Highly Hazardous Chemical Standard (29 CFR 19.10.119). This instruction revises previous OSHA instructions (CPL 2-2.45A) and identifies amendments to the Standard for Explosives and Blasting Agents (29 CFR 1910.109).

This interim memo will provide comparable guidance in relation to the Washington Industrial Safety and Health Act (WISHA) until a final directive is issued addressing the enforcement of WAC 296-67. A copy of CPL 2-2.45A CH-1 has been distributed to all WISHA supervisors. Future WISHA guidance may confirm or modify portions of the guidance provided by the federal memo.

Policy

WISHA compliance staff shall follow OSHA CPL 2-2.45A CH-1 in conducting inspections and enforcing WAC 296-67 (Management of Highly Hazardous Chemicals).
