This rulemaking is a result Chapter 432 Laws of 2009 (Substitute House Bill 1555). The legislation amended the Contractor Registration law to require contractors to maintain a list of subcontractors on the jobsite. The rules need to be updated in order to reflect the recent changes.

This rulemaking is a result of Second Substitute Senate Bill 6732, which was passed by the 2008 Legislature. The Contractor Registration rules need to be updated to be consistent with the statute and with industry practices. The rulemaking will also review the contractor registration rules for additions; such as incorporation of program policies, revisions and clarification. The changes were adopted 5/5/2009 and became effective on 6/6/2009.

This rulemaking is a result of Chapter 436, Laws of 2007 (Substitute House Bill 1843), which passed the 2007 Legislature. The legislation closed loopholes that left consumers vulnerable and strengthened L&I’s ability to enforce current law. The legislation corrects recent court rulings that conflicted with past practices, adds a requirement to a prevailing party in a suit against a contractor to notify L&I of all judgments and legal actions resulting from the suit, and increases a violations of the statute to a gross-misdemeanor which will allow the department and local prosecutors additional time to build a case against an unregistered contractor. It also lowers the threshold that allows the department to triple the contractors bond. The changes were adopted 8/4/2008 and became effective on 9/4/2008.

A 3.38% fee increase, which is the Office of Financial Management’s maximum allowable fiscal growth rate factor for fiscal year 2007. The fee increase will help cover the cost of the ongoing services of the Contractor Registration, Elevator, Factory Assembled Structures, and Plumber Certification programs.
