Details

The Department of Labor & Industries’ (L&I) Division of Occupational Safety and Health (DOSH) and the Fraud Prevention and Labor Standards division (FPLS) is conducting rulemaking to implement and enforce Engrossed Substitute Senate Bill 6105 (ESSB 6105), passed during the 2024 legislative session. ESSB 6105 makes updates to existing safety and health requirements under chapter 49.17 RCW, and makes updates to wage and hour requirements under chapter 49.46 RCW.

During this stakeholder meeting, staff from both DOSH and FPLS will provide a brief overview of ESSB 6105, answer questions, and seek stakeholder feedback to assist with scoping the preliminary drafts of the rules.

The DOSH rulemaking will implement the requirements of Section 1 of ESSB 6105, codified at RCW 49.17.470. Some of the changes which will be addressed in this rule include:

  • Requirements that an adult entertainment establishment provide accessible panic buttons, and must submit annual proof of compliance and panic button maintenance to L&I;
  • Requirements for security personnel availability, task dedication, and when additional security may be needed;
  • An update to the definition of adult entertainment; and
  • Other areas in chapter 296-831 RCW which may requirement amendments based on the rulemaking.

The FPLS rulemaking will implement the requirements of Section 2 of ESSB 6105, codified in chapter 49.46 RCW. Some of the topics that will be addressed in the rulemaking include:

  • Fee requirements, including leasing fees; 
  • Written notices of termination or refusal to hire; 
  • Prohibiting retaliation; and
  • Enforcement mechanisms

Sections 1 and 2 of ESSB 6105 take effect January 1, 2025.
