Labor & Industries (L&I) will hold a stakeholder meeting June 26 to consider preliminary draft rule language addressing working conditions in adult entertainment establishments. Your participation will assist in the development of the preliminary drafts.
Engrossed Substitute Senate Bill 6105 (ESSB 6105), passed during the 2024 legislative session, makes updates to existing safety and health requirements under chapter 49.17 RCW, and adds language addressing wage and hour requirements under chapter 49.46 RCW. L&I’s Division of Occupational Safety and Health (DOSH) will implement the requirements of Section 1 of ESSB 6105, and the Fraud Prevention and Labor Standards (FPLS) division will implement Section 2. Those requirements are being adopted under a separate, but coordinated, rulemaking effort. Sections 1 and 2 of ESSB 6105 take effect January 1, 2025.
L&I filed two Preproposal Statements of Inquiry (CR-101) on May 7, 2024:
DOSH rulemaking filing
FPLS rulemaking filing
This meeting will provide both an in-person and virtual participation option. DOSH and FPLS will present an overview of the preliminary draft rules, answer questions, and seek feedback to assist with further development of the preliminary draft rules.
Preliminary Draft Rules:
• Adult Entertainer Safety (DOSH) - Updates to Chapter 296-831 WAC
• Labor Standards for Adult Entertainment Establishments (FPLS) - Updates to Chapter 296-128 WAC
