Labor and Industries (L&I) has several rulemakings in-progress for the Factory Assembled Structures (FAS) Program.

First, L&I is considering a fee increase for permits, inspections, and other services for factory-assembled structures. A fee increase is needed to cover increased operating costs for the FAS Program. L&I is also considering other changes to the rules to update the fees. If adopted, the rules would take effect November 1, 2022. See WSR 22-09-086

Second, L&I filed an emergency rule on April 19, 2022 (WSR 22-09-063), to expedite plan review for modular buildings, among other structures. This is an extension of the procedure already in place in the Washington Administrative Code (WAC). The emergency rule allows customers to use an agency-approved licensed professional engineer or architect to review plans for factory-built structures, recreational park trailers, recreational vehicles, and conversion vendor units (such as food trucks). The emergency rule also clarifies what a design plan submission must include and how to submit design plans for approval for commercial coaches and factory-built housing and commercial structures. The emergency rule is in effect for 120 days. 

Third, L&I is considering changes to the FAS rules under chapter 296-150F WAC. The changes under consideration would implement new legislation, allow manufactured building panels to be inspected and approved before shipment to a construction site in Washington State, and make updates and other rule changes.

Updates on the status of these rulemakings will be provided during the quarterly FAS Advisory Board meeting.
