Details

The Department of Labor & Industries (L&I) is conducting rulemaking to implement the new requirements regarding quotas at warehouse distribution centers created by Second Substitute House Bill (2SHB) 1762 (2023). 2SHB 1762, codified under chapter 49.84 RCW, goes into effect July 1, 2024.

L&I initiated rulemaking on October 11 by filing two separate Preproposal Statements of Inquiry (CR-101), one for rules to be enforced by the Division of Occupational Safety and Health (WSR 23-21-059) and one for rules to be enforced by Fraud Prevention and Labor Standards (WSR 23-21-058). The rulemaking efforts will be jointly coordinated. In the coming weeks, L&I will share a preliminary draft of the rule language for a first round of stakeholder feedback.

L&I is conducting two virtual (Nov. 27 and Dec. 1) and two in-person (Nov. 29 and Nov. 30) stakeholder meetings to receive comments on preliminary draft rule language, share information, and respond to questions. The preliminary draft language will be shared prior to the first stakeholder meeting. If you are unable to attend one of the in-person or virtual meetings, you will also have the opportunity to provide written comments on the preliminary draft rule language. There will be additional opportunities for stakeholder participation and feedback throughout this rulemaking process, including a formal comment period and public hearings on the proposed rules in spring of 2024.
