The purpose of this adoption is to implement requirements of 2022’s Engrossed Substitute House Bill 2076 (ESHB 2076) concerning rights and obligations of transportation network company drivers and transportation network companies. This new law provides workers’ compensation insurance coverage to TNC drivers during dispatch platform time and passenger platform time, among other rights and protections. Drivers previously exempt from workers’ compensation coverage will be covered starting January 1, 2023. TNCs will report and pay for coverage. This rule adoption amends the reporting and classification rules under WAC 296-17-35205 and 296-17A-1401 to address the new requirements.
