Workplace Violence Prevention in Health Care
Status
L&I is conducting rulemaking related to workplace violence prevention in healthcare.
Rulemaking officially began with a CR-105 (Expedited Rulemaking) filed on October 1, 2024. L&I received timely objections to the expedited rulemaking process. Upon receiving the objections, L&I paused the rulemaking process (per RCW 34.05.353(8)) to review the draft language and to incorporate new updates to RCW 49.19.020, Workplace violence prevention plan as a result of Second Substitute House Bill 1162 in 2025. L&I is now moving forward with the standard rulemaking process and will file a CR-102 Proposed Rulemaking later this year.

The purpose of this proposed rulemaking is to create new chapter 296-830 WAC Workplace violence prevention in health care, to adopt into rule statutory requirements under chapter 49.19 RCW, Safety – Health care settings; chapter 49.95 RCW, Long-term care workers; and chapter 72.23 RCW, Public and private facilities for mentally ill.
The requirements under these existing statutes require employers in the health care industry to establish a program to address workplace violence and abusive behavior in the work place, which includes creating policies, providing training to employees and recording incidents. Prior to this rulemaking, DOSH has addressed enforcement of these requirements through DOSH Directive 5.07.
