Details
The Department of Labor & Industries (L&I) Division of Occupational Safety and Health (DOSH) is conducting rulemaking to implement the requirements under Chapter 49.19 RCW, Safety – Health care settings; Chapter 72.23 RCW, Public and private facilities for mentally ill; and Chapter 49.95 RCW, Long-term care workers. Also included in this rulemaking are changes from RCW 49.19.020 based on Second Substitute House Bill 1162, passed in 2025.
The statutes require employers in covered health care industries to establish a program to address workplace violence and abusive behavior, which includes creating policies, providing training to employees and recording incidents. Prior to this rulemaking, DOSH addressed enforcement of the requirements under chapter 49.19 RCW and chapter 72.23 RCW, and through DOSH Directive 5.07.
L&I previously filed an expedited rulemaking proposal on October 1, 2024 (WSR 24-20-114), to which timely objections were received per RCW 34.05.353(8).
At the meeting, DOSH staff will provide an overview of the preliminary draft rule, answer questions, and receive stakeholder feedback. For additional information about this rulemaking, please visit the rulemaking stakeholder information webpage.
